My tenant is getting married soon, do I need to update the tenancy agreement with their new married name?
Answer
No, legally you don’t have to change anything straight away.
If it isn’t too much trouble, it is a good idea to put a note at the bottom of the agreement saying that the name has changed, and ask your tenant to sign this – this will show that you are aware that the name has changed, but there is no immediate need to re-issue the whole document.
When it comes to the time for renewal, make sure you change the name officially then. Don’t forget, it is likely that your tenant may be looking to move their new spouse into the property as well, and this must be taken into account when you are drafting the new tenancy agreement. Your tenant’s new spouse may require referencing, and possibly even a guarantor, so make sure that you ask what their plans are.
Lastly, don’t forget to congratulate the happy couple – it’s always good to keep relationships with your tenants on a positive note, they’ll appreciate the fact that you’ve remembered!
