I have an existing tenant on a periodic tenancy agreement. Will I need to carry out a Right to Rent on them when they renew?
Answer
As long as nothing has changed, then no.
If your tenant’s details have all remained the same, and you are not adding anyone to the agreement, you do not have to carry out the Right to Rent checks. The checks are only required for new tenancy agreements which start after the 1st February, so a ‘rolling contract’ will not require them.
Should the details of the landlord change, checks will need to be carried out by the new landlord. In this instance, the tenant would be starting a new agreement with the new landlord, so checks would be required.
