Can I fit solar panels without my tenant's approval?

I’d like to fit solar panels on my property, but I’m not sure what my tenants will think. Can I go ahead anyway?

Answer

This is a tricky question as although you do own the property, when you sign a tenancy agreement you sign over some of your right to the building over to your tenants for the duration of the lease.

With this in mind, we would highly recommend you take the time to discuss this is in detail with your tenants and make sure that they are in agreement about the plan before you go ahead.

If your tenant isn't in agreement, it is possibly worth considering waiting to fit the panels until the tenancy comes to an end. Your tenants are within their right to sue you should you choose to go ahead with structural changes to the property without their agreement.
